|
Das Recht des Geistigen Eigentums steht vor erheblichen Herausforderungen. Diese treten etwa bei der Bestimmung der Reichweite der Schutzrechte bzw. ihrer Schranken sowie der Kumulation von Schutzrechten in Erscheinung. Zudem ist das aktuelle Regelungsgefuge einem hohen Legitimationsdruck ausgesetzt, weil Normen uberholt sind, nicht den gewunschten Interessensausgleich sicherstellen oder gleiche Sachverhalte grundlos verschieden geregelt werden. Das Werk greift diese Aspekte auf und geht der Frage nach, ob sich die einzelnen Schutzrechte auf einheitliche, abstrahierbare Grundsatze zuruckfuhren lassen. Hierfur erarbeitet der Autor zunachst eine Definition fur einen Allgemeinen Teil, um auf dieser Grundlage und ausgehend von einem umfassenden Uberblick uber internationale Kodifikationen und den nationalen Normenbestand, Regelungsvorschlage fur einen Allgemeinen Teil zu entwickeln. |
