|
Quarante ans après l’écriture des textes constitutionnels français et tunisien, les études rassemblées dans cet ouvrage, issues d’un colloque tenu à Tunis en décembre 1999, esquissent une mise en perspective comparée des évolutions juridiques dans les deux pays. À cette occasion sont notamment abordées les questions relatives aux rapports entre pouvoirs publics, au fondement démocratique du pouvoir, aux droits fondamentaux et au contrôle de constitutionnalité. Plus largement, cette comparaison entre droit constitutionnel tunisien et droit constitutionnel français permet d’aborder certains thèmes généraux et transversaux à l’ensemble du droit : problème du mimétisme, évolution de la fonction du juge, influence du droit international et du droit communautaire, définition des concepts juridiques. |
