• Sommario/riassunto: Das Sachenrecht ist eine Hauptmaterie des Privatrechts. Das Eigentum, insbesondere das an Grundstücken, ist der zentrale Begriff des verfassungs- und einfachrechtlichen Rechtsschutzes. Mit dieser Einordnung verliert der Stoff jede Trockenheit. Es entwickelt sich vielmehr ein erheblicher Reiz: So ist das gesamte System unseres Rechtsschutzes vom Eigentum als Prototyp der subjektiven Rechte und des Rechtsschutzes her zu verstehen. Den Ansatz, unser Recht als Gesamtsystem zu begreifen, verfolgt das vorliegende Buch von Jan Wilhelm. Das Grundsätzliche ist in allen Details zu entfalten. Die Zuordnung der Rechte zu mehreren Personen, sei es in Gestalt der Bruchteilsgemeinschaft (insbesondere beim Wohnungseigentum), sei es in Gestalt der Gesamthands-Personengesellschaften, weiter das internationale Sachenrecht und das europäische Sachenrecht, und sodann Grundbuch, Besitz und die einzelnen Sachenrechte werden untersucht. Das Buch schließt mit der zentralen Rolle der privaten subjektiven Rechte als Mittel der Kreditsicherung. Eine Besonderheit des Buches besteht in der Auseinandersetzung mit der Rechtsprechung. Diese ist nach Kräften bis zum Jetztstand berücksichtigt. Grundsätzlich bedeutsame Entscheidungen werden nicht nur angeführt, sondern als vollständige Falllösungen präsentiert. Ein Handbuch für Wissenschaft und Praxis des Privatrechts. Ein Lehrbuch für die Studierenden zur Erörterung und Vertiefung von Einzelfragen.
