|
Le présent ouvrage a pour objet de contribuer à une meilleure compréhension des changements intervenus en matière de protection de la personne des malades mentaux et de celle des biens des personnes incapables. Les lois du 26 juin 1990 et du 18 juillet 1991 ont en effet introduit en droit belge des ruptures remarquables par rapport à la législation du siècle passé qu'elles ont abrogée. Il a dès lors semblé utile de tenter de cerner la spécificité du but poursuivi par le législateur à l'occasion de cette réforme mais aussi de mieux saisir dans la pratique quotidienne la réalité du changement souhaité par le législateur. À cette fin il est apparu opportun de solliciter par priorité des praticiens juristes et psychiatres pour qu'ils fassent état de leur expérience professionnelle dans le cadre de ces lois nouvelles, mais aussi et surtout afin qu'ils explicitent la manière dont ils comprennent celles-ci et entendent les mettre en œuvre. |
