De tous côtés s'observent des phénomènes d'accélération du temps juridique : en attestent, notamment, le rythme accéléré d'adoption, de transformation et d'abrogation des lois, le succès de la justice des référés, le déclassement rapide des solutions et des doctrines. Philosophes et sociologues le confirment : l'urgence, jadis temporalité d'exception, s'impose aujourd'hui comme temps normal. Le Séminaire interdisciplinaire d'études juridiques a entendu prendre la mesure de cette évolution et la soumettre à interrogation critique. Les interrogations abondent en effet. Car, si l'accélération suppose une vitesse accrue, que faut-il penser d'un droit précipité et improvisé ? Si elle s'entend comme immédiateté, que penser d'un droit dépourvu ou incapable de médiation ? Et si elle doit être comprise comme aléa, que penser d'un droit incapable d'assurer la sécurité juridique ? Il est vrai cependant que retards excessifs (« délais déraisonnables »), blocages et atermoiements caractérisent aussi la vie juridique contemporaine ; ne faut-il pas penser dès lors que c'est à un phénomène plus vaste qu'on assiste : la perte de maîtrise du temps par le droit, comme s'il parvenait malaisément à trouver le juste équilibre entre stabilité et changement ? Par ailleurs, s'il est vrai que l'accélération pourrait signifier la réalisation résolue, à un rythme de plus en plus soutenu, d'un objectif clair et mobilisateur, il est cependant plus réaliste de penser que, dans le droit contemporain, elle traduit plutôt une valorisation du changement pour lui-même, signe de la montée des incertitudes dans des sociétés entièrement indexées à l'instant présent. Se fait alors entendre cette question de philosophie du droit : si le propre du droit est d'instituer la société - nouer le lien social en l'inscrivant dans une perspective temporelle - ne doit-on pas considérer qu'un minimum de durée (stabilité, médiation, certitude) lui est nécessaire ?
