Cadre de vie de l'espèce humaine dont la protection doit être assurée, ensemble de ressources matérielles susceptibles d'appropriation mais aussi modèle rationnel de légitimation ou essence de l'homme, telles sont, entre autres, les diverses signification que l'idée de nature peut revêtir en droit. Conjuguant des recherches partant sur plusieurs branches du droit positif (droit de l'environnement, droit pénal, droits intellectuels,…) avec une réflexion qui procède de la philosophie et des sciences humaines, les travaux du Séminaire interdisciplinaire d'études juridiques sur le thème Images et usages de la nature en droit permettent de discerner non seulement les sens et les fonctions de l'idée de nature en droit, mais aussi les enjeux pratiques de la relation de l'homme à la nature. |
