L’analyse économique des droits d’auteur dans le secteur du cinéma s’est fondée sur des données provenant tant du CNC que des sociétés de perception et de répartition de droits (SPRD) concernées qui ont permis l’examen détaillé d’un échantillon de cent films de long métrage. Les auteurs et artistes-interprètes sont à la fois nombreux et divers dans la production d’un film : scénaristes, réalisateurs, auteurs de musique mais aussi éventuellement auteurs de l’œuvre littéraire adaptée,



adaptateurs-dialoguistes, comédiens… L’analyse des modes de rémunérations et des prises de risques fait ressortir le poids des rémunérations salariales pour les comédiens, la généralisation des minima garantis pour les auteurs en lieu et place d’une rémunération proportionnelle qui se maintient surtout pour les auteurs de musique. Au-delà des salles, les différents modes d’exploitation (télévision, vidéo…) donnent lieu à des compléments de rémunération au travers d’arrangements contractuels qui misent plus ou moins sur les espérances de succès avec des formes complexes d’intéressement, de rémunération après amortissement, de mise en participation… Ceci conduit à des rémunérations peu lisibles mais fortement dépendantes de la notoriété des ayants droit dans leurs rapports au producteur, cessionnaire présumé des droits, autour de notions controversées comme la recette nette de ce dernier ou les conditions d’amortissement.  The economic study of authors’ royalties in the film industry is based on data from the CNC and the body (SPRD) which collects and apportions the money concerned. These data provide the material for examining a sample of a hundred feature films in detail. The making of a film involves numerous authors and performing artists – scriptwriters, directors, composers – as well as book adapters, dialogue writers, actors. An examination of modes of remuneration and risk-taking reveals the prevalence of salaries for cast and guaranteed minima for authors, rather than percentage…
