|
The dissertation investigates in which way the juvenile penal law allows for victim rights. This question is treated dogmatically and discussed in the lights of an empirical survey made specifically for this dissertation. |
Der Gesetzgeber hat die Stellung des Verletzten im Strafverfahren in den letzten Jahrzehnten erheblich verändert. Die dem Verletzten nach und nach eingeräumten Informations-, Mitwirkungs- und Schutzrechte "stören"das klassische Gegenüber von strafverfolgendem Staat und Angeklagten. In wichtigen Bereichen des Strafverfahrens muss daher eine neue Balance hergestellt werden. Das ist besonders prekär im vom Erziehungsgedanken beherrschten Jugendstrafverfahren. Die Arbeit untersucht, inwiefern die Besonderheiten des Jugendstrafverfahrens eine Berücksichtigung von Opferrechten zulassen. Im ersten Teil der Arbeit werden die dogmatischen Grundlagen einer Einbeziehung des Verletzten in das Jugendstrafverfahren dargestellt und die einzelnen Verletztenrechte ausführlich erörtert. Über die bloß theoretische Diskussion hinaus, wird im zweiten Teil der Arbeit der Konflikt zwischen den Verfahrensrechten des Verletzten und der erzieherischen Ausrichtung des Jugendstrafverfahrens empirisch beleuchtet. The series Topics in Current Chemistry presents critical reviews of the present and future trends in modern chemical research. The scope of coverage is all areas of chemical science including the interfaces with |

The goal of each thematic volume is to give the non-specialist reader, whether in academia or industry, a comprehensive insight into an area where new research is emerging which is of interest to a larger scientific audience. The most significant developments of the last 5 to 10 years are presented using selected examples to illustrate the principles discussed.
