"For over 30 years the LDF's primary criminal justice objective has been to eliminate capital punishment. Historically there has been discriminatory application of capital punishment against the poor and blacks. In the 1987 McCleskey decision where LDF argued that the death penalty is imposed more frequently against persons (especially black persons) who kill whites, the U.S. Supreme Court did not question the validity of the evidence and even agreed that a correlation does exist between race and the death penalty. However, the Court held that defendants must prove, on a case-by-case basis, intentional racial bias and discrimination by prosecutors, jurors, or judges"--Preface, pages vii-viii,1975/1988 volume.
