Long description: Die gut hundert Jahre alte These Fritz Kerns über die Natur der mittelalterlichen Anschauung vom Recht vermochte bald nach Erscheinen, die verfassungs- und rechtshistoriographischen Mediävistik in ihren Bann zu ziehen. Das trifft besonders auf den deutschsprachigen Raum zu. Aber es gilt selbst über ihn hinaus, denn als good old law gab es Kerns Lehre auch andernorts. Die Studie unternimmt es nicht, seinen Ansatz zu bekräftigen oder zu widerlegen, sondern macht ihn erstmals selbst zum Gegenstand einer historiographiegeschichtlichen Untersuchung: Wie und warum entstand das Kernsche Konzept, und welche Funktion erfüllte es? Sie richtet sich an Rechts- und Verfassungshistoriker sowie an Mediävisten und Wissenschaftshistoriker. |
