Secondo una definizione ormai consolidata nella più recente cultura giuridica italiana, il diritto all'identità personale è il diritto di ognuno a che la proiezione sociale della propria personalità non subisca travisamenti o distorsioni a causa della attribuzione di idee, opinioni o comportamenti differenti da quelli che l'individuo ha manifestato nella vita di relazione. Frutto degli sforzi creativi di un corposo orientamento giurisprudenziale, che inizia ad emergere nella seconda metà degli anni '70, in parte incoraggiato e in parte avversato dalla dottrina, il diritto all'identità personale si è imposto come nuovo diritto fondamentale della persona, e la sua rilevanza costituzionale è stata riconosciuta dalla stessa Corte Costituzionale. Il volume esamina l'atmosfera culturale che ha preparato il terreno all'emergere di questo nuovo diritto, il percorso giurisprudenziale che ne ha definito i confini e i contesti di applicazione, il dibattito dottrinale che ne ha vagliato il fondamento normativo, l'opportunità giuspolitica e la rilevanza costituzionale. |
